Owen F. Duffy, Successfully Vacates Rule B Attachment
Owen F. Duffy recently argued against a plaintiff’s motion for reconsideration of a court’s order and opinion granting defendant’s motion to vacate the process of attachment and garnishment and dismissing the complaint. Vacatur of attachments are rarely granted by the courts. Mr. Duffy, however, has developed a level of expertise in such matters, which has been repeatedly recognized by courts, attorneys, and the New York Law Journal. In fact, several opinions documenting Mr. Duffy’s achievements in regards to maritime attachments have appeared in the Decisions of Interest section in the Journal.
Mr. Duffy’s most recent success, OGI Oceangate Transportation Co. Ltd. V. RP Logistics Pvt. Ltd. 06 Civ. 9441 (Decided 10/04/07), was published as a Decision of Interest by the New York Law Journal on Tuesday, October 23, 2007. On a prior motion concerning the same matter, Mr. Duffy effectively persuaded the court to vacate the attachment. Plaintiff, subsequently, moved the court to reconsider. The District Court, Judge Sweet presiding, denied plaintiff’s motion for reconsideration. The court accepted Mr. Duffy’s arguments that plaintiff failed to state a valid prima facie maritime claim for wrongful arrest, that vacatur was appropriate because plaintiff appeared in the arrest action in India, and that vacatur was appropriate because sufficient security had already been obtained.
